PLEASE READ THESE STAYWEB TERMS OF SERVICE CAREFULLY, AS IT CONTAINS IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS AND REMEDIES.

Overview

This Universal Terms of Use Agreement (this “Agreement”) is entered into by and between StayWeb LTD and you and shall enter into force on the date of use of this website or the date of electronic acceptance. This agreement sets out the general terms and conditions for your use of the site and the services purchased.

The terms “we”, “us” or “our” will refer to StayWeb Ltd. The terms “you”, “your”, “user” or “customer” refer to any natural or legal person who accepts this agreement and uses the Services. Nothing in this Agreement shall be construed to confer any rights or advantages on third parties.

Changes in these terms and conditions 

We reserve the right, in our sole discretion, to modify or replace these Terms at any time.

Use of this site or services after such changes or modifications will constitute your acceptance of this Agreement, as last revised. If you do not agree to be bound by this Agreement, as last amended, do not use (or continue to use) this site or services. In addition, StayWeb may notify you from time to time of changes or modifications to this Agreement by email. Furthermore, StayWeb may terminate the use of your Services for any breach or breach of any of the terms of this agreement by you.

Eligibility

This site and the Services are available only to individuals or legal entities who may enter into legally binding contracts by applicable law. By using this Site or the Services, you represent and warrant that you can enter into legally binding contracts under applicable law, or that you are not a person prohibited from purchasing or receiving the Services under United Kingdom law.

If you are entering into this Agreement on behalf of a corporate entity, you represent and warrant that you have the legal authority to bind such corporate entity to the terms and conditions contained in this Agreement, in which case the terms “you”, “your”, “User” or “customer” shall refer to such corporate entity.

General rules of conduct

You acknowledge and agree that:

Your use of this Site, including any content you submit, will comply with this Agreement, any applicable Services Agreement or policy that may apply to your Services and all applicable local, national and international laws, rules and regulations.

You will not use this Site if:

Is illegal, or encourages illegal activity;

  • Promotes encourages or participates in terrorism, violence against people, animals or property;
  • Promotes encourages or engages in any spam or other unsolicited group email or hacking of a computer or network;
  • Infringes the intellectual property rights of another User or any other individual or legal entity;
  • Contains or installs any viruses, worms, bugs, Trojans or other code, files or programs designed or capable to disrupt, damage or limit the functionality of any software or hardware;

You will not circumvent, disable or otherwise interfere with the security-related features of this site or the Services.

You are aware that StayWeb may call you from time to time and that for each call you may be subject to the recording of conversations and thereby consent to the same, subject to all applicable laws and our restrictions and obligations on them, including, where permissible, to record such calls in full, whether or not StayWeb asks you for a specific invitation to consent to record such a call. You further acknowledge and agree that, to the extent permitted by applicable law, any such record(s) may be presented as evidence in any legal proceedings to which StayWeb is a party.

Projects policy

StayWeb implements each project in three parts:

  • Logo/design. This may include their client logo designs and photos. StayWeb team will implement them in a graphic format suitable for web environments. For 100% guaranteed results StayWeb reserves the right to communicate and cooperate with the client throughout the project for optimal results via WhatsApp, Viber, Email or any other communication environment.
  • This is the stage in which, after the approval of the design by the client, the developers of StayWeb prepare, and program the website or the online store. Once completed, the site will be uploaded to the StayWeb server, the client will have temporary access with a password and user for review. After approval by the client, proceed to step three.
  • This is the stage where the customer purchases a host and domain or orders StayWeb to purchase, and then the website or online store is implemented live.

Payments

Projects implemented by StayWeb are paid for in three steps by the client (an exception is our promotional campaign at offers.stayweb.co.uk there is one payment without hidden fees). You agree that the implementation of each phase of the project will not start until we receive payment in the bank account of StayWeb. The amount will be according to your offer without hidden fees and conditions. All our offers are without VAT and are due by the client based on an entire offer.

Payment by each customer will be in three phases or as follows:

1. Preparation/implementation of an existing design/logo – the client owes 30% of the total offer and the preparation by StayWeb will not start if it is not paid or until it is paid.

2. Programming of the website / online store – the client owes 50% of the project amount and the phase will not start if it is not paid or until it is paid.

3. Live implementation; the client owes the remaining 20% of the project amount. No rights will be granted on the website / online store if the customer does not pay the amount or until he pays.

Any payment must be made as soon as possible by you, but no later than 14 days after the invoice is sent. StayWeb reserves the right to terminate any contract or project for which it has not received payment 14 days after sending the invoice to the client, regardless of which phase the project is in, without refunding previous payments related to this project.

Promotional packages

Our six promotional packages (free website, up to 3 pages, up to 6 pages, custom pages, small e-commerce, and e-commerce) are available on offers.stayweb.co.uk.
The packages can be purchased through the website via debit or credit card, Apple pay, Google pay, PayPal, and Amazon pay.
- We do not charge any additional or hidden fees.
- We do not include unremovable StayWeb logos or watermarks on the client’s website.
- We do not make any restrictions on the websites.
- You will have access to all files and accounts for the website, including sensitive databases essential for the website to operate.

- We do not take any responsibility if the client deletes, moves, replaces, or renames any important files which affect significantly the website performance or even prevent the website from working.
- We are not responsible if the client deletes, removes, or moves any design elements from the front or back end including pictures, text, logos, maps, banners, or any other design we created.
-If we discover any of the cases above we do not issue any refund or we may ask for a fee to restore or rebuild the files to make the website work again.
We will provide hosting based on cPanel for each individual client. We will connect your custom domain name or we will provide a subdomain for free (yourname.stayweb.co.uk).
The hosting for all the packages (excluding the free website) is free for the first year. Afterwards, if you would like us to keep providing hosting services it will be £99+VAT per year. However, in case you decide to use another hosting provider we can transfer your files without additional fees.
We will include all of the features included on offers.stayweb.co.uk for each package and will consider if the website needs additional features for free on a case-by-case basis.
StayWeb keeps the right to suspend any account or service without explanation and to refuse to issue a refund if discover illegal or immoral activities by any clients.

 

Domain and hosting

The domain and hosting are purchased by the customer from a provider of their choice (third party) we provide hosting and free subdomain only for our promotional packages also can be purchased from a third party by our team for which a fee will be due which includes the amount of the purchase.

Because the domain and hosting are purchased from a third party, StayWeb will not refund the amount for the hosting package, domain or email server purchased from us.

Refund policy

In any case, the funds deposited for a project are not refundable after delivery if the original design concepts are approved or a change is requested unless StayWeb cancels or terminates your Contract for a reason other than your breach or non-performance.

All claims for reimbursement will be executed by the following agreement:

You can request a refund when the original logo/design concepts are offered. After the design/logo has been approved by the customer, refund requests will not be considered and approved, the contract will be terminated and the website / online store will not be executed and the remaining amount under the contract will not be required by StayWeb.

If the refund request is made before the delivery of the design concepts (logo/design),then you will be entitled to an 80% refund of the payment made by the client.

The StayWeb recovery policy described above applies to each of the three stages of project development.

No refunds will be made after the website is completed or after the website is implemented live.

All refund requests must be reported to the support department. StayWeb reserves the right to approve or disapprove your request on a case-by-case basis based on a breach of your user agreement.

The money-back guarantee is based on the fact that the order is made in good faith. When a client has placed design orders with more than one design company for the same work to request a refund, we do not consider this to be in good faith. In this case, we reserve the right to refuse a request for a refund.

All project designs require customer feedback before finalizing the design, so it is fair for the customer to get involved and provide feedback to achieve the desired results.

Any resemblance to an existing design will be a mere coincidence and StayWeb will not assume any liability or claim for compensation in such a case. It is the client’s responsibility to protect their copyrighted works.

How to request a refund

To ensure that your refund request is approved, please make sure you meet the following requirements

We will try to resolve your case immediately under our review policy, or we will email you a refund request approval from our Refund Department. After the refund, your design rights will be obtained from StayWeb and you will not be able to display any version of the design submitted by the company.

Let us also specify that:

As the design rights will now be transferred to the company, you agree that you have no right (directly or indirectly) to use any response or other content, work product or media, nor will you have any interest in the property or the same.

Quality assurance policy

To provide you with the desired satisfaction, our designers do not deviate from the specifications provided by you in the order form.

The design is created after strong research, which guarantees the quality and uniqueness of the design.

100% satisfaction guarantee

We rework the ordered design and continue to review it until you are 100% satisfied.

Delivery policy

All your files at the beginning of a project are provided by a convenient method for all parties such as email, WhatsApp, Viber or any other agreed communication environment. The files must contain a detailed description of your business, logo or design if not implemented by us and everything related to the project we are working on including the content for the website. Upon completion, we will receive a notification of your chosen method of communication. The deadline depends on the type and complexity of the project. StayWeb team will work hard to implement it as quickly as possible. All policies related to review and refund will be implemented in the time from receipt of the amount on the account until approved by the client.

 

No spam

StayWeb does not tolerate the transmission of spam. We monitor all traffic to and from our spam indication web servers and maintain a spam abuse complaint centre to record allegations of spam abuse. Customers suspected of using our products and services to send spam are fully investigated. If we find that there is a problem with spam, we will take appropriate action to resolve the situation. We define spam as the sending of unsolicited commercial e-mail, unsolicited group e-mail or unsolicited facsimile (fax),which is an email or fax sent to recipients as advertising or otherwise, without prior consent for receiving their communications. This may include, but is not limited to, the following:

  • Email messages
  • Discussion group publications
  • Windows system messages
  • Pop-up messages (also known as “adware” or “spyware”)
  • Instant messaging (using AOL, MSN, Yahoo or other instant messaging programs)
  • Ads in the online chat room
  • Guestbook posts or forum website
  • Send a facsimile
  • Text / SMS messages

We will not allow our servers and services to be used for the purposes described above. To use our products and services, you must not only comply with all applicable laws and regulations, which include the Spam Act 2003 and the Consumer Protection Act, but you must also comply with this spam policy. Commercial advertising and/or group emails or faxes may only be sent to recipients who have opted in to receive messages.

Links to third parties websites 

Our service may contain links to websites or services of third parties that are not owned or controlled by StayWeb.

StayWeb has no control over and is not responsible for the content, privacy policies or practices of third-party websites or services. You further acknowledge and agree that the Company shall not be liable, directly or indirectly, for any damages or losses caused or claimed to be caused by or in connection with the use or reliance on such content, goods or services available on or through such websites or services.

We strongly encourage you to read the terms and conditions and privacy policies of the third-party websites or services you visit.

Record support

We keep a record of your final design one year after we provide you with the final files.

If you need final files again in the future, we can send them to you at your request.

Communication policy

You agree that StayWeb is not responsible for any correspondence from email address (es) other than those followed by our domain, ie. “.. @stayweb.co.uk” and/or any toll-free number not mentioned on our website StayWeb.co.uk shall not be liable for any damages caused by such correspondence. We take responsibility only for any communication via email address (es) under our domain name and/or through our phone number and related applications such as WhatsApp.

Access to information 

To access StayWeb’s services, you will be asked to provide certain data for communication with you or other information. By accepting these terms, you acknowledge that all information provided by you will be accurate, current and complete. If StayWeb believes that the information you have provided is incorrect or/and incomplete, StayWeb reserves the right to deny you access to any services or any of its resources and to terminate or suspend correspondence.

Language control 

This Agreement, together with all policies and applicable product agreements identified above and incorporated herein by reference (collectively, the “Agreement”),shall be implemented in the English language. To the extent that any translation is provided to you, it is provided for convenience only, and in the event of a conflict between the English and translated versions, where permitted by law, the English version will have control and take precedence. When the translated version is required to be provided to you and is to be considered binding by law (i) both language versions will have equal validity, (ii) each party acknowledges that it has reviewed both language versions and that they are substantially the same in all material respects; and (iii) in the event of any inconsistency between the two versions, the translated version may prevail, provided that the intention of the parties has been fully taken into account.
